The District seems to be getting around this by not disclosing the true nature of the area in its CBCMRIF application Section 7 Environmental disclosure:

- The District applied on the basis of a 2000 petition, for which they'd already destroyed the records.
- Once the District obtained the grant, CSWVA re-petitioned, using the grant as leverage to gain signatures,even though the District was required to have the LSA & Bylaws passed BEFORE it applied for the grant.
- In fact, the District said in their application that there was a resolution in place.
- The latest petition was certified by the District in April 2008.
- Following much confusion and anger in the neighborhood, a meeting was held in May, as described by the municipal administrator. At this meeting, the Administrator recommended a public process.
- Upon his recommendation, a public meeting was held in June, where the public was able to learn the TRUTH about the project, unlike what they had been told by petitioners.
- Since the Administrator's memo and the public meeting, numerous citizens have publicly withdrawn their support: 1 | 2 | 3 | 4 | 5 | 6 and numerous properties have changed hands. The people who tried to withdraw their signatures (as they were garnered on the basis of false information) were told by the District that the District would not remove their names.

- The petition was also missing attachments, and citizens were told to go to FOI to get the attachments
- According to the District's Solicitor the Petition would likely fail a Review under the Judicial Review Act. , however the District would not allow people to withdraw. At present, the District is moving ahead with the process of drawing up the ByLaws, on the basis of the highly flawed petition.
